TERMS AND CONDITIONS OF THE ONLINE STORE

Preliminary Provisions

The online store Stradale-design.com available at www.stradale-design.com is operated by JM Luxury Cars Sp. z o.o., ul. Radwańska 56/2, 93-574 Łódź, entered into the Central Registration and Information on Business Activity (CEIDG), NIP: 7282883119.

These Terms and Conditions are addressed to Consumers and define the rules and procedure for concluding a Distance Sales Agreement with a Consumer via the Store.
§ 2
Definitions
Consumer – a natural person concluding an agreement with the Seller within the Store, where the subject of the agreement is not directly related to their business or professional activity.
Seller – JM Luxury Cars Sp. z o.o., ul. Radwańska 56/2, 93-574 Łódź, entered into CEIDG, NIP: 7282883119.
Client – any entity making purchases through the Store.
Entrepreneur – an entity performing business activity in its own name.
Store – the online store at www.stradale-design.com
Distance Agreement – an agreement concluded with the Client without simultaneous physical presence of the parties, using distance communication means.
Terms and Conditions – this document.
Order – a declaration submitted via the Order Form aimed at concluding a Sales Agreement.
Account – a customer account in the Store.
Registration Form – the form enabling Account creation.
Order Form – the form enabling Order placement.
Cart – software element showing selected Products.
Product – a movable item or service available in the Store.
Sales Agreement – a Product sales contract concluded via the Store.

Technical Requirements
To use the Store:

Internet-enabled device and browser,

active e-mail address,

cookies enabled,

FlashPlayer installed.
§ 5
General Information

The Seller is not liable for interruptions caused by force majeure, unlawful third-party actions, or incompatibility of Client’s equipment.

Browsing does not require an Account; placing Orders is possible with or without an Account.

Prices are in PLN and include VAT.
-
The final price includes Product price and delivery cost.
-
For subscriptions, the final price includes the full billing period.
-
If final price cannot be determined upfront, the method of calculation is provided.
§ 6
Registration, Account Creation, Account Deletion

The Client may register and create an Account. Benefits include:
-
ability to use Account features,
-
access to order history and data updates,
-
no need to re-enter data for each Order.

Registration is free and voluntary but required to create an Account.
-
Registration is performed via the registration form at https://fugi.pl/moje-konto/.
-
Required data: name, surname, address, email.
-
The Client must protect their password and maintain updated antivirus software.
-
Data must be kept updated by the Client.
-
Account deletion is possible at any time by emailing: jmluxurycars.biuro@gmail.com

Rules for Placing an Order
To place an Order:

log in or proceed without registration,
-
select a Product and add it to the Cart,
-
fill in the Order Form,
-
click “Order and pay”,
-
choose a payment method and complete the payment.
§ 8
Delivery and Payment Methods
Delivery methods:
-
courier shipment.
Payment methods:
-
bank transfer,
-
electronic payments,
-
payment cards (Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro).

§ 9
Execution of the Sales Agreement

A Sales Agreement is concluded when the Client receives an e-mail confirming receipt and acceptance of the Order.

Payment must be made within 10 days for transfers/e-payments.
-
Delivery times depend on Product descriptions.
-
For multiple Products, the longest delivery time applies unless partial delivery is requested.
-
Delivery time begins upon bank account crediting.
-
Personal collection is possible after receiving an e-mail notification.
7a. Processing time within the EU: 7–10 business days. Custom orders: up to 21 days.
7b. Outside the EU: 21–30 business days.

Delivery is worldwide.
-
Delivery is paid unless otherwise specified.

Personal collection is free.
§ 10
Right of Withdrawal

The Consumer may withdraw within 14 days without reason.
-
The withdrawal period begins upon receipt of the Product.
-
For multiple/batched deliveries, the period runs from the final delivery.
-
For subscriptions, from receipt of the first item.
-
Withdrawal must be submitted by mail or email.
-
The Seller confirms receipt of electronic withdrawal.
Effects of Withdrawal:

the Agreement is void,
-
full refund within 14 days,
-
refund withheld until Product return or proof of return,
-
return shipping costs are borne by the Consumer,
-
Consumer is liable for diminished value due to improper use.
Withdrawal is not permitted for:
-
custom-made goods,
-
sealed goods opened after delivery,
-
perishable goods,
-
fully performed services with prior consent,
-
price-dependent market fluctuation goods,
-
inseparably mixed goods,
-
sealed audio/video/software opened after delivery,
-
newspapers/magazines (except subscriptions),
-
digital content delivered non-physically with prior consent.
§ 11
Complaints and Warranty

Products are new.
-
The Seller must deliver defect-free Products.
-
Complaints may be submitted via email or the complaint form.
-
The Seller must respond within 14 days.
-
Returns must be sent to the address in § 3.
-
Warranty information is provided with the Product if applicable.
§ 12
Out-of-Court Dispute Resolution
Consumers may use:
-
permanent arbitration courts,
-
mediation by Trade Inspection,
-
free assistance from consumer ombudsmen and organizations.

Personal Data in the Online Store

The Seller is the data administrator.
-
Personal data is processed to perform the Sales Agreement and, if the Client consents, for marketing.

Data recipients include:

carriers for delivery,
-
payment operators.
-
The Client may access and correct data.
-
Providing data is voluntary but necessary to conclude the Agreement.
§ 14
Final Provisions

Agreements are concluded in Polish.
-
Terms may change for legal or operational reasons; Clients will be informed 7 days in advance.
-
Polish law applies.
-
